Community Safety: Know Your Rights

At Toad’s Market, we stand with our neighbors. We know that encounters with immigration enforcement (ICE) can be frightening. It is important to remember that everyone in the United States has basic rights protected by the Constitution, regardless of their immigration status.

If ICE Comes to Your Door:

Do Not Open the Door: ICE cannot enter your home without a judicial warrant signed by a judge or a court. They often carry "administrative warrants" (Form I-200 or I-205), but these do not give them the right to enter your home without your permission.

Ask to See the Warrant: Ask them to slide the warrant under the door or hold it up to a window. Look for your correct name, address, and a signature by a judge or court.

Remain Silent: You have the right to remain silent. You do not have to answer questions about where you were born, how you entered the U.S., or your immigration status. You can say: "I am exercising my right to remain silent and will not speak without an attorney."

Do Not Sign Anything: Do not sign any documents without speaking to a lawyer first.​

Record the Encounter: If it is safe to do so, take photos or video and write down badge numbers and the number of agents present.

If You Are Stopped on the Street:

Ask: "Am I free to go?" If they say yes, walk away calmly.

If they say no, exercise your right to remain silent.

Do not run and do not resist arrest, as this can be used against you.
